1. Agreement to these terms
These Terms of Service (“Terms”) govern your use of the rapidality.com website and the mobile applications published by Rapidality LLC (“Rapidality,” “we,” “us”). By using our website or apps, you agree to these Terms. If you do not agree, do not use our services.
2. License to use our apps
We grant you a personal, limited, non-exclusive, non-transferable, revocable license to install and use our apps on devices you own or control, for your own personal, non-commercial use, in accordance with these Terms and the rules of the store from which you obtained the app.
3. Acceptable use
You agree not to: (a) copy, modify, distribute, sell, or lease any part of our services; (b) reverse engineer or attempt to extract the source code of our apps except where the law permits it; (c) use our services to violate any law or the rights of others; (d) interfere with or disrupt the operation or security of our services; or (e) access our services by automated means for scraping or data harvesting.
4. Intellectual property
Our website, apps, and all associated content — including software, design, text, graphics, and trademarks such as “Rapidality” and our app names — are owned by Rapidality LLC or its licensors and are protected by intellectual property laws. Nothing in these Terms transfers any ownership to you. Content you create within our apps (for example, your own logs and entries) remains yours.
5. Purchases and subscriptions
Purchases made through the Apple App Store or Google Play are billed and refunded by Apple or Google under their terms. Purchases made directly from Rapidality are governed by our Refund & Cancellation Policy.
6. Apple App Store terms
Apps distributed through the Apple App Store are additionally subject to Apple’s standard Licensed Application End User License Agreement (EULA). You acknowledge that these Terms are between you and Rapidality LLC only, not Apple; that Apple is not responsible for our apps or their content; that Apple has no obligation to provide maintenance or support for them; and that Apple and its subsidiaries are third-party beneficiaries of these Terms with the right to enforce them against you as they relate to your use of our apps.
7. Disclaimer of warranties
OUR WEBSITE AND APPS ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT OUR SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE. OUR APPS ARE NOT MEDICAL DEVICES AND DO NOT PROVIDE MEDICAL ADVICE.
8. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, RAPIDALITY LLC WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, PROFITS, OR GOODWILL, ARISING FROM YOUR USE OF OUR SERVICES. OUR TOTAL LIABILITY FOR ANY CLAIM WILL NOT EXCEED THE GREATER OF FIFTY US DOLLARS ($50) OR THE AMOUNT YOU PAID US IN THE TWELVE MONTHS BEFORE THE CLAIM AROSE. SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS, SO SOME OF THESE MAY NOT APPLY TO YOU.
9. Termination
You may stop using our services at any time. We may suspend or terminate your access to our services if you violate these Terms or where required by law. Sections that by their nature should survive termination — including intellectual property, disclaimers, and limitations of liability — survive.
10. Governing law and disputes
These Terms are governed by the laws of the State of New Mexico, USA, without regard to conflict-of-law principles. Any dispute arising from these Terms or our services will be brought exclusively in the state or federal courts located in Bernalillo County, New Mexico, and you consent to their jurisdiction.
